Electronic prescribing was legalized for Schedule II through V controlled substances at the national level in 2010 by the Drug Enforcement Agency (DEA). Alabama

3 New PDMP Laws

The prescription drug monitoring program bill (HB 150) clarifies language authorizing the Board of Medical Examiners to regulate the physician’s use of the state’s PMP. Physicians can now allow staff members to access the database on their behalf. The bill also allows the Medicaid Agency to access the database to check the controlled substance prescription medication history of patients enrolled in Medicaid.

The pain management bill (HB 151, PDF) strengthens regulation of pain management clinics where drugs are prescribed for chronic, nonmalignant pain. Under the new law, pain management clinics must be registered with the Alabama Board of Medical Examiners, and must have a medical director who is a physician licensed in Alabama. The law also allows the Alabama Board of Medical Examiners to issue subpoenas while investigating clinics.

The “doctor shopping bill” (HB 152, PDF) makes it a Class A misdemeanor to lie to doctors about similar prescriptions to get more drugs. Convictions are punishable with up to a year in jail; after four convictions, the offense becomes a Class C felony, which is punishable by a sentence of up to 10 years.

This is important to urologists because lowering overhead and increasing revenues is vital to the financial health of a practice. IMS’ current customers have found that once the urologists and their staff become familiar with the system, their clinic’s efficiency and productivity will rise. Electronic prescribing conduits now meets stringent Drug Enforcement Administration (DEA) security requirements for e-Prescribing of federally designated controlled substances and have begun a limited deployment of its technology in three states (Texas, California and Virginia). This development removes one of the last remaining technical barriers to wider physician adoption of e-prescribing.

E-Prescribing Penalty

Starting in 2014, some physicians who fail to prescribe electronically will be subject to a 2 percent Medicare payment penalty. The penalty will be applied to individual eligible professionals or group practices participating in the Electronic Prescribing Group Practice Reporting Option (GPRO) who have not successfully submitted the target number of e-prescriptions based on their number of eligible providers.

In July 2012, the state implemented legislation that requires practitioners and pharmacists to register with KASPER. Before prescribing a potentially addictive drug, practitioners are required to obtain a KASPER report on the patient’s controlled substance prescription history. The law also mandates that practitioners review a patient’s treatment plan at regular intervals and before issuing additional controlled substance prescriptions or refills. Pharmacies are required to report every controlled substance prescription they dispense.

To apply for a significant hardship exemption in order to avoid receiving a 1.5 percent Medicare Part B payment penalty for 2013, eligible professionals and group practices participating in the group (GPRO) must apply by June 30th, 2012 for the 2013 Medicare eRx significant hardship exemption. Even if you applied for an eRx significant hardship exemption last year to avoid the 2012 eRx payment penalty and were approved by CMS, you must reapply to avoid the 2013 payment penalty.

E-prescribing Program

NYS Medicaid E-prescribing Incentive Program — Effective January 1, 2010, Medicaid prescribers can receive an incentive payment of $0.80 per dispensed Medicaid e-prescription, and eligible retail pharmacies can receive $0.20 per dispensed medicaid e-prescription. Incentives are calculated and dispersed by Medicaid program without need for submission of data. Includes one original fill and up to five (5) refills within 180 days are each eligible for an incentive payment to both the prescriber and pharmacy, provided that the refilled item is picked up by or delivered to the beneficiary.

E-Prescribing Mandate

E-prescribing will be required for all New York State prescriptions effective March 27, 2016, pursuant to regulations adopted by New York State. While the E-prescribing mandate goes into effect on March 27, 2016, physicians who comply with these regulations may now begin to electronically prescribe controlled substances (EPCS), as long as their EPCS systems are DEA certified. E-prescribing Mandate

The New York State Legislature unanimously passed Senate Bill 7637 which enacted the Internet System for Tracking Over-Prescribing (I-STOP) Act and creates a Prescription Monitoring Program registry (PMP). The passage of this act requires professionals to consult the PMP before prescribing a Schedule II-IV drug by August 27, 2013. Additionally, after March 27, 2016, the bill will mandate all prescribers to electronically prescribe all Schedule II-IV drugs.

Controlled Substance Registry — Effective August 27, 2013 As of August 27, 2013, all doctors prescribing or dispensing a Schedule II, III, or IV controlled substance in any quantity must query a new controlled drug Registry. To access the Registry, you must establish an online Health Commerce System (HCS) account. All doctors who directly dispense any controlled substance in any Schedule in any quantity to a patient must input into the registry the information concerning the controlled drug they directly dispensed to that patient.

E-Prescribing Restrictions

Electronic prescribing conduits now meets stringent Drug Enforcement Administration (DEA) security requirements for e-prescribing of federally designated controlled substances and have begun a limited deployment of its technology in three states (Texas, California and Virginia). This development removes one of the last remaining technical barriers to wider physician adoption of e-prescribing.

Substitute Senate Bill 6105 (2012) was signed into law on March 29, 2012 and effective as of June 28, 2013. The law requires the department to work with the Veterinary Board of Governors to establish alternative data reporting requirements for the Prescription Monitoring Program by either electronic or non-electronic methods. It also clarifies that drugs dispensed for one-day use do not need to be reported to the PMP.
